Work Performance Evaluations

           I want to write about what to do if you don't receive your work performance evaluation on time. There are different procedures for the different bargaining groups, so I will outline this by bargaining group so it is easy to follow.


SAFETY UNIT / SAFETY MANAGEMENT & SUPERVISORY UNIT

           The procedure for this falls under the Merit Advancements section of your Memorandum of Understanding (MOU). It states that your Work Performance Evaluation shall be completed by your immediate supervisor within sixty (60) work days prior to your step advance benefit date for all employees who are below the top step of their salary range. If you are a meets standards or better, you will receive your step advancement.

           If you do not receive your Work Performance Evaluation in the time frame listed above, you should contact your supervisor who must complete and file the Work Performance Evaluation within five (5) work days. This is very important. If you do not receive your Work Performance Evaluation on time and you do not inform your immediate supervisor you will not be able to file a grievance because you did not follow the procedure. Remember you have to submit a grievance within fifteen (15) work days from when you became aware of the conditions precipitating the grievance. So, if you do not get your Work Performance Evaluation on time and you wait longer than 15 work days, you forfeit your right to file a grievance.

           If you have ever been told that your Work Performance Evaluation is being held up because of a current investigation, you can still request your Work Performance Evaluation be completed. Like the procedure says, your supervisor must complete and file the Work Performance Evaluation within five (5) work days.

           If you request your Work Performance Evaluation be completed and it is not completed in the time frame specified, contact your SEBA representative so we can begin the grievance process.


SPECIALIZED PEACE OFFICER UNIT & SPECIALIZED PEACE OFFICER SUPERVISORY UNIT

           Your procedure for this also falls under the Merit Advancements section of your Memorandum of Understanding (MOU). This section states that the Work Performance Evaluation for a regular status employee shall be completed by the employee's immediate supervisor within six (6) pay periods prior to the employee's step advance due date.

           In cases where no Work Performance Evaluation is filed by your step due date, you should contact your department payroll Specialist who shall contact your immediate supervisor to complete the Work Performance Evaluation within fifteen (15) working days. If your evaluation is not completed in this time frame, you need to submit a written request to your department Human Resources Officer to direct the completion of the evaluation. If the work performance evaluation is not completed within thirty (30) work days, you will be granted the merit step increase retroactive to the original step advance eligibility date.

           Unlike the Safety Unit / Safety Management & Supervisory Unit, you do not have to file a grievance. Your MOU outlines what happens if your supervisor does not complete the Work Performance Evaluation in the time frame listed. But, it is up to you to begin this process.

SPECIALIZED FIRE SERVICES UNIT

           Your procedure for Work Performance Evaluations also falls under the Merit Advancements section of your Memorandum of Understanding (MOU). This section states your Work Performance Evaluation for regular status employees shall be completed by your immediate supervisor within a period of thirty (30) work days prior to your step advance benefit date or annual evaluation date.

           In cases where no Work Performance Evaluation is filed in a timely manner, you should contact your supervisor who must complete and file the Work Performance Evaluation within five (5) work days. If you are rated as "Meets Job Standards" or better, you will be granted the step advancement retroactive to your salary benefit date, provided the delayed rating was the responsibility of your supervisor.

           Your MOU is similar to the Safety Unit / Safety Management & Supervisory Unit MOU; whereas there is no defined remedy in cases where your supervisor does not get the Work Performance Evaluation completed in the specified time frame. In these cases just like the aforementioned MOU, if you do not receive your Work Performance Evaluation on time and you do not inform your supervisor you will not be able to file a grievance because you did not follow the procedure. Remember you have to submit a grievance within fifteen (15) work days from when you became aware of the conditions precipitating the grievance. So, if you do not get your Work Performance Evaluation on time and you wait longer than 15 work days, you forfeit your right to file a grievance.

           If you do request your Work Performance Evaluation be completed and it is not completed in the time frame specified, contact your SEBA representative so we can begin the grievance process.
