Probation Corrections
Officers - Welcome to SEBA!
The first few days have been a whirlwind of activity, but it is
a pleasure working with all of you. You will find that we will be
working with you on many aspects of your employment and will address
certain issues in the Rap Sheet.
Recently we have found that many of the regulations and procedural
protections granted to the PCOs have not been followed by supervision.
Those protections are also in place for supervision. It is incumbent
upon supervision to follow the law with regard to the protections
afforded the PCOs under Government Code Sections 3300 - 3311.
Section 3306.5 allows officers to access to their personnel files
and to provide a way for an officer to delete information or correcting
information in his or her file. For a refresher course, all memos
or paperwork that are kept at IA, HR, or the supervisor's desk are
considered personnel files. That means that a supervisor cannot
keep derogatory information in the WPE file which has not been seen
and signed by the employee.
The employee has a right under Sec. 3303(i) to have an association
representative present for an interview or interrogation by a supervisor
or IA personnel. That means if, after having been given reasonable
notice, you called your representative at SEBA in a timely fashion
and your representative isn't available at the time the interrogation
is to take place, the person conducting the interview must arrange
it so that the representative can be present.
We have heard that some areas of the Peace Officers Bill of Rights
have not been routinely enforced over the years at the institutions,
but with some practice and patience I am sure the new PCOs and their
supervisors will be up to snuff in no time.
